Refund Policy

****The following is a brief summary of the standard cancellation policy for The Cube apartments. For full terms and conditions, please refer to the apartment's 'Booking Terms and Conditions'. ***Policies are subject to real-time changes; please refer to the apartment contract for the definitive version. Cancellation Policy (England and Wales) 1. Booking Deposit When booking The Cube apartment, you are required to pay a booking deposit. Payment of the booking deposit signifies your agreement that the apartment may retain this deposit to secure your room under these terms. After paying the booking deposit, you must sign the tenancy agreement within the following timeframe: if the deposit is paid before 19 August, the agreement must be signed by that date; if paid after 19 August, the agreement must be signed within 14 days of payment, or by any alternative deadline mutually agreed upon between you and the apartment (the "Deadline"). Once the tenancy agreement is signed, part of the booking deposit will be converted into a refundable security deposit, and the remainder will be applied toward the first rental payment. If your tenancy agreement is an Assured Shorthold Tenancy (AST), the security deposit will be held in a government-approved independent deposit protection scheme (e.g., the Tenancy Deposit Scheme, TDS). Unless otherwise stated on the apartment’s website, the security deposit will be refunded to you at the end of the tenancy, provided there are no outstanding rent payments and no damage to the room or communal areas. By paying the booking deposit, you expressly consent to the apartment using the personal information you provide to screen against sanctions lists maintained by the governments of the UK, the US, and other relevant jurisdictions (including the US Office of Foreign Assets Control, OFAC). This screening does not affect your rights under the Data Protection Act 2018 or the apartment’s obligations toward you. You may request that the apartment refrain from conducting such screening; however, the apartment will be unable to proceed with your application. The apartment will verify your university offer and subsequently send you an accommodation registration form via the student portal. Upon receipt of your completed registration form, the apartment will issue you an accommodation offer, followed by an electronic copy of the tenancy agreement via email, together with a guarantor form to be completed and signed by your UK-based guarantor. Please confirm receipt of the email, verify your personal details, read the tenancy agreement carefully, and complete the contract signing process. The tenancy agreement sets out in detail the terms of your tenancy with the landlord, your guarantor, and 11 Popes Lane Property Management Ltd / 10 Denham Street Property Management Ltd (as managing agents). Unless you have a UK-based guarantor, you must pay the full annual rent upfront. If you do have a UK-based guarantor, you may select a customised payment plan for rent; however, the first rental payment must be made at least three weeks prior to the start of the tenancy — failure to do so will prevent you from moving in. If, for any reason, the apartment is unable to issue you an accommodation offer, it will contact you as soon as possible to explain the reason or propose an alternative. If no alternative is offered or accepted by you, the apartment will refund your booking deposit in full via the original payment method. 2. Cancellation by You – Cancellation Within the Cooling-Off Period If you choose to cancel your booking, you may do so within seven days of signing the tenancy agreement (i.e., the cooling-off period). You may cancel by sending an email to the apartment. A refund of the booking deposit will only be issued if you cancel within seven days of paying the booking deposit. If you cancel after the cooling-off period expires, the booking deposit will not be refunded, and your guarantor (if applicable) will remain liable for obligations under the tenancy agreement. 3. Prior to Signing the Tenancy Agreement The landlord and managing agent reserve the right to withhold the booking deposit and cancel your booking if any of the following occur: 3.1 The apartment has taken all reasonable steps to sign the tenancy agreement with you by the Deadline, but you fail to cooperate — for example, by not completing the registration form promptly or not providing your guarantor’s details and supporting documents on time; 3.2 You provide false or misleading information to the apartment; 3.3 The apartment is unable to enter into a tenancy agreement with you due to restrictions imposed by the Immigration Act 2014. 4. After Signing the Tenancy Agreement If you have signed the tenancy agreement and the cooling-off period has expired, the apartment permits contract termination before 19 August (inclusive), provided the following conditions are met and sufficient evidence is submitted: - If you are a prospective undergraduate fresher, and your preferred university or higher education institution withdraws its offer due to unmet academic entry requirements, or you accept an offer from another university based on superior academic performance. To qualify under the above condition, you must: - Provide written confirmation of rejection from your chosen university or higher education institution within 72 hours of receiving your examination results; - Submit a copy of your acceptance letter from the new university. If the documentation you submit under this clause is reasonably acceptable to both the apartment and the landlord, you may cancel your booking and will be released from all contractual obligations under the tenancy agreement effective from the date of cancellation. # No Visa No Pay For undergraduate freshers who fail to obtain a UK visa before the tenancy commencement date, the apartment will cancel the tenancy agreement and refund all paid rent — provided you submit the following documents within 72 hours of receiving official notification of visa refusal: - Official visa refusal documentation; - A written confirmation of cancellation. # Cancellation for Other Reasons If you have signed the tenancy agreement, the cooling-off period has expired, and none of the above cancellation conditions apply, the booking deposit will not be refunded. Your guarantor (if applicable) remains fully liable for obligations under the tenancy agreement, regardless of whether you have collected your room key. If you cancel your booking and identify a suitable replacement tenant (subject to the apartment’s approval), you will be released from all contractual obligations under the tenancy agreement. The apartment will refund any overpaid rent, less a cancellation fee equal to the amount of the booking deposit. The apartment’s on-site team will confirm your official termination date. 5. Cancellation After Move-In 5.1 If you decide to leave during the tenancy term for any reason, the apartment may agree to terminate the contract only if the following conditions are satisfied: 5.1.1 You may not assign or sublet the tenancy rights arising from the tenancy agreement to any third party without the apartment’s prior written consent (per Clause 11.1(m) of the tenancy agreement); 5.1.2 You must secure a suitable replacement tenant who signs a new tenancy agreement covering the remainder of your lease term: 5.1.2.1 The replacement tenant must be at least 18 years old and enrolled as a full-time student at a university or college located near the apartment. If the apartment has a partnership agreement with a specific university, the replacement tenant may be restricted to students from that institution — please consult the apartment team for clarification; 5.1.2.2 The replacement tenant must sign a tenancy agreement with the apartment and make all required payments under that agreement; 5.1.2.3 Where reasonably required, the replacement tenant must provide an appropriate guarantor who accepts the terms of the tenancy agreement; 5.1.2.4 Refunds will only be processed once the replacement tenant has signed the tenancy agreement, completed all payments, and moved in. 5.1.3 If you find a replacement tenant, you will be charged a £500 administration fee; if you fail to do so, you remain liable for the full rent until the end of the tenancy term. 6. Cancellation by the Apartment Per the apartment’s terms, you must sign the tenancy agreement by 19 August of your intended move-in year. If you fail to do so by this deadline, the apartment may cancel your booking via email. If the cooling-off period has already expired, the booking deposit will not be refunded. If you fail to check in on the scheduled move-in date and have not yet signed the agreement, the apartment may cancel your booking at any time via email. If the cooling-off period has expired, the booking deposit will not be refunded. Once you have signed the tenancy agreement, it may only be terminated by mutual agreement or under the circumstances described in Section 3 above. 7. Room and Tenancy Modifications # Tenancy Duration Modification You cannot shorten the tenancy duration, but you may request a free extension of the tenancy period prior to the tenancy start date (subject to room availability). # Tenancy Start Date Modification To modify your tenancy start date, please contact the apartment directly. # Room Change Prior to the tenancy start date, you may upgrade your room or switch to another room of the same type at no cost, subject to availability. Room changes after the tenancy start date incur applicable fees.
